Terms of Service.

1. Acceptance of these terms

These Terms of Service ("Terms") are a legal agreement between you and Caleb Pierce, doing business as cfwebdev ("cfwebdev", "I", "me"), a sole proprietorship located in Orlando, Florida, United States.

By using this website, or by engaging cfwebdev for services, you agree to these Terms. If you do not agree, please do not use the site or engage the services.

If a separate signed proposal, statement of work, or written agreement covers a project, that document controls where it conflicts with these Terms.

2. Use of this website

This website is provided for information about cfwebdev services. You agree not to use it to break the law, to attempt unauthorised access to it or its infrastructure, to disrupt its operation, or to scrape it for the purpose of impersonating cfwebdev.

All content on this site, including text, layout, design, code, and graphics, is owned by cfwebdev or used with permission, and is protected by copyright. You may view and share links to it. You may not copy the site wholesale, resell it, or present it as your own work.

Concept and demonstration work

Some portfolio pieces are clearly labelled fictional concepts created to demonstrate design ability. Cypressline is one of these. Concept businesses are not real clients, their content is illustrative, and nothing on a concept page should be read as a claim of completed client work, a testimonial, or a business result. Stock photography used in concepts remains licensed to its original source, which is credited in the concept's source record.

3. Services and scope

cfwebdev offers fixed-price website packages, currently a Website Rescue Mini and a Lead Page Sprint, along with bounded overflow work for agencies. The inclusions, exclusions, revision allowance, and target turnaround for each package are stated on the homepage and confirmed in writing before work begins.

Fixed scope means fixed scope. Work outside the agreed inclusions, including additional pages, additional fixes beyond the agreed number, new features, ecommerce, migrations, rebrands, backend or server-side failures, and ongoing maintenance, is not included. I am glad to do that work; it is quoted separately and agreed in writing first.

I may decline or end an engagement where the request is unlawful, deceptive, infringing, abusive, or outside what I can competently and honestly deliver.

4. Quotes and pricing

Packages, prices, and turnaround times shown on this site are invitations to start a conversation, not binding offers. Actual client engagements are governed by the written agreement, proposal, or invoice for that specific project, and those documents control if they differ from anything on this site.

Prices shown on this website are the current published prices for the described packages and may change at any time. The price that applies to your project is the one confirmed in writing when the engagement is agreed. A confirmed quote is honoured for that project even if published prices change afterwards.

Prices are in United States dollars and exclude any taxes, third-party fees, paid software, stock media licences, hosting, and domain costs, unless a quote expressly says otherwise.

6. Your responsibilities

To deliver on time I need you to provide, in reasonable time: content, images, and brand assets; access to the relevant website, hosting, domain, or platform accounts; a single point of contact empowered to give feedback and approval; and timely responses.

You confirm that any material you give me is yours to use, or that you hold the necessary licence or permission, and that it does not infringe anyone's rights or break the law. You agree to indemnify cfwebdev against third-party claims arising from material you supplied or instructed me to use.

You are responsible for the accuracy of your own business claims, prices, and legal content, including any privacy policy, terms, or disclosure your website requires for your industry.

7. Timelines

Published turnaround times are targets, not guarantees, and they begin when I have the access, assets, and information needed to start. Delays in receiving materials or feedback move the target. I will tell you promptly if a date is at risk.

8. Revisions

Each package includes one round of revisions: a consolidated set of change requests delivered together, within the agreed scope. Revisions refine the agreed work. A change of direction, a new page, or a new feature is new work, quoted separately.

9. Defect window

For 14 days after delivery, I will correct at no charge any defect in the work I delivered: something that does not function as agreed, or was built incorrectly. This covers my work only. It does not cover changes of mind, new requests, issues caused by later edits by you or another party, third-party platform or plugin changes, hosting outages, or pre-existing problems outside the agreed scope.

11. Third-party services

Projects often rely on third-party services such as hosting, domain registrars, content platforms, email providers, and plugins. Those services are governed by their own terms and pricing, are outside my control, and their fees are your responsibility unless agreed otherwise. I am not responsible for outages, policy changes, price changes, or discontinuation by a third-party provider.

12. AI assistance

I use AI-assisted tools as part of my process, and I personally review every deliverable before it reaches you. You get work I stand behind. I do not put your credentials or confidential material into public AI services for training. If your organisation requires specific limits on AI use, tell me before work starts and I will confirm them in writing.

13. Dae Calendar

Dae Calendar is an internal scheduling tool operated by the studio for its own use. It is provided as is, without warranty, and is not offered as a product or service to the public. Its handling of Google user data is described in the privacy policy.

14. No performance guarantee

I build websites well. I do not control search engines, advertising platforms, algorithms, competitors, or markets. cfwebdev therefore makes no guarantee of search rankings, traffic, impressions, leads, enquiries, conversion rates, sales, or revenue, and any example, estimate, or discussion of potential outcomes is illustrative rather than a promise.

15. Warranty disclaimer

This website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. I do not warrant that the site will be uninterrupted, timely, secure, or error-free.

Services are performed in a professional and workmanlike manner consistent with industry standards. Beyond the defect window in section 9 and any express written commitment, no further warranty is given. Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, cfwebdev is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or lost or corrupted data, arising out of or relating to this website or the services, even if advised of the possibility.

To the maximum extent permitted by law, cfwebdev's total aggregate liability for any claim arising out of or relating to a project is limited to the amount you actually paid for that project. For claims relating to use of this website where no fees were paid, total liability is limited to one hundred United States dollars ($100).

You are responsible for maintaining your own backups of your website, content, and data. I take reasonable care, but I am not a backup service.

17. Termination

Either of us may end an engagement in writing. If you end it, you pay for work performed up to that point. If I end it other than for your breach, you pay only for work performed and I will hand over what has been paid for. Sections covering ownership, disclaimers, limitation of liability, indemnity, and governing law survive termination.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. The exclusive venue for any dispute is the state or federal courts located in Orange County, Florida, and you consent to that jurisdiction.

Before filing anything, we agree to first try to resolve the matter in good faith by direct discussion. Most problems are solved with an email and a phone call.

19. General

If any provision is found unenforceable, the rest stays in force and the unenforceable part is applied as closely as the law allows. A failure to enforce a term is not a waiver of it. These Terms, together with any signed proposal or statement of work, are the entire agreement between us on this subject. You may not assign an engagement without my written consent.

Updated Terms are posted here with a new date and apply to engagements agreed after that date. Existing projects continue under the terms in place when they were agreed.
